1.3 Legal Basis for Processing
All personal data processing activities conducted by NexalithSolutions are grounded in the following legal bases as defined by the EU General Data Protection Regulation (GDPR):
- Consent (Article 6(1)(a)): Where you have provided explicit, informed, and unambiguous consent for specific processing purposes, such as receiving marketing communications or enabling non-essential cookies.
- Contractual Necessity (Article 6(1)(b)): Where processing is necessary for the performance of a contract to which you are a party, or for taking pre-contractual steps at your request, including the delivery of requested real estate portal development services.
- Legitimate Interest (Article 6(1)(f)): Where processing is necessary for the purposes of legitimate interests pursued by NexalithSolutions, such as fraud prevention, service improvement, and security monitoring, provided these interests are not overridden by your fundamental rights.

- To deliver, maintain, and improve the real estate portal development services contracted by our clients.
- To analyze portal usage patterns and optimize search engine performance, filter accuracy, and user experience across our platforms.
- To comply with applicable legal, regulatory, and tax obligations under Spanish and EU law.
- To detect, prevent, and address technical issues, security vulnerabilities, and fraudulent activities on our systems.
- To send service-related communications, including project updates, invoice notifications, and technical maintenance alerts.
1.5 Data Retention Periods
NexalithSolutions retains personal data only for the duration necessary to fulfill the purposes for which it was collected, or as required by applicable law. Specifically:
- Contact form submissions: Retained for 24 months from the date of submission, after which they are securely deleted unless an active business relationship has been established.
- Contractual data: Retained for the duration of the service agreement plus 6 years, in compliance with Spanish commercial and tax record-keeping obligations.
- Analytics data: Aggregated and anonymized after 14 months. Individual-level analytics data is not retained beyond this period.
- Cookie data: Session cookies expire upon browser closure. Persistent cookies do not exceed 12 months from their initial placement.
1.6 International Data Transfers
NexalithSolutions processes data primarily within the European Economic Area (EEA). Where data transfers occur outside the EA, we ensure appropriate safeguards are in place, including Standard Contractual Clauses (SCCs) approved by the European Commission, adequacy decisions, or binding corporate rules as applicable under Chapter V of the GDPR.
1.7 Your Rights Under GDPR
As a data subject, you possess the following rights under the General Data Protection Regulation:
- Right of Access (Article 15): The right to obtain confirmation of whether your personal data is being processed and to receive a copy of that data.
- Right to Rectification (Article 16): The right to request the correction of inaccurate personal data or the completion of incomplete data.
- Right to Erasure (Article 17): The right to request the deletion of your personal data where there is no compelling reason for its continued processing.
- Right to Restriction (Article 18): The right to request the restriction of processing under specific circumstances.
- Right to Data Portability (Article 20): The right to receive your personal data in a structured, commonly used, and machine-readable format.

REFUND POLICY

3.1 Service Delivery Terms
NexalithSolutions delivers digital real estate portal development services, search engine integration, and related technical consulting on a project basis. All service engagements are initiated through a formal project agreement that outlines deliverables, timelines, and payment milestones.
3.2 Refund Eligibility
Refunds are evaluated on a case-by-case basis according to the project milestones achieved at the time of the refund request:
- Pre-Development Phase: If a refund request is received before any development work has commenced, a full refund of any advance payment will be issued within 14 business days.
- During Development: If a refund request is received after development has commenced, the refund amount will be calculated proportionally based on completed versus remaining deliverables as defined in the project agreement.
- Post-Delivery: Refund requests received after final delivery and client acceptance of all deliverables will not be eligible for monetary refund. NexalithSolutions will instead offer bug fixes and technical corrections within the agreed warranty period.
3.3 Non-Refundable Items
The following are not eligible for refund:
- Third-party licensing fees (domain registrations, hosting subscriptions, API access tokens) already incurred on behalf of the client.
- Custom design work that has been approved through the client review cycle.
- Data migration services that have been partially or fully executed.
3.4 Refund Process
To request a refund, contact NexalithSolutions at [email protected] with your project reference number and a written description of the refund reason. All refund requests will be acknowledged within 3 business days and resolved within 30 business days. Refunds will be processed via the original payment method used for the transaction.

TERMS OF SERVICE

4.1 Acceptance of Terms
By accessing and using the services provided by NexalithSolutions, located at Calle Aurora Boreal 5, Piso 3 B, Madrid, Spain, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use our services.
4.2 Service Scope
NexalithSolutions provides the following categories of services:
- Custom real estate portal development and deployment.
- Property search engine integration and optimization.
- MLS data synchronization and feed management.
- Interactive map visualization and geolocation services.
- Mobile application and progressive web app development.
- Analytics dashboard construction and data visualization.
- Virtual tour integration and 360° content systems.
- Lead generation system design and implementation.
The specific scope, deliverables, and timelines for each engagement are defined in the applicable project agreement executed between NexalithSolutions and the client.
4.3 Payment Terms
All payments are processed through our authorized payment infrastructure. Unless otherwise specified in the project agreement:
- A 40% advance payment is required upon project agreement execution.
- A 30% milestone payment is due upon delivery of the development environment for client review.
- A 30% final payment is due upon project completion, client acceptance, and production deployment.
- All prices are quoted in Euros (€) and are exclusive of applicable VAT unless otherwise stated.
- Late payments incur a statutory interest rate of 8% per annum plus the ECB reference rate, in accordance with Spanish commercial law.
4.4 Intellectual Property
Upon receipt of full payment for a project, NexalithSolutions assigns to the client all intellectual property rights in the custom-developed deliverables, including source code, design assets, and documentation. NexalithSolutions retains the right to use anonymized project data and general technical approaches in its portfolio and marketing materials, unless the client explicitly objects in writing.
Third-party components, libraries, and frameworks used in project delivery remain subject to their original open-source or commercial licenses, as documented in the project's technical specification.
4.5 Warranty and Support
NexalithSolutions provides a 90-day warranty period following final project delivery, covering defects in workmanship and functionality as defined in the project specification. During the warranty period, NexalithSolutions will resolve reported defects at no additional cost within agreed response times.
Post-warranty support, hosting management, and feature enhancements are available under separate maintenance agreements.
4.6 Limitation of Liability
To the maximum extent permitted by applicable law, NexalithSolutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our total aggregate liability for any claim arising from or related to any single project engagement shall not exceed the total fees paid by the client for that specific project.
4.7 Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Spain and the European Union. Any dispute arising out of or relating to these terms or the services provided by NexalithSolutions shall be subject to the exclusive jurisdiction of the courts of Madrid, Spain.
